Refunds & cancellations
If plans change
Last updated: 28 October 2026
This policy applies to website builds and care plans supplied by Dzevad (Jevad) Huseinbegovic trading as Breakwater Web Co, ABN 30 395 825 899. It forms part of the Terms of Service supplied with your quote.
Contact [email protected] or 0478 527 613 if you want to cancel or discuss a problem. An email is helpful so we both have a record, but you do not lose a legal remedy because you first contact me another way.
Your rights come first
My services come with rights under applicable law, including Australian Consumer Law guarantees where they apply. These cannot be removed by this policy, a quote, payment, your approval of a draft or the launch of your website.
For a major service failure, you may be entitled to cancel and receive a refund for the affected services, or keep the agreement and receive a price reduction. For a problem that can be remedied and is not major, I will put it right without charge within a reasonable time. If that does not happen, further remedies may be available. You may also be entitled to compensation for reasonably foreseeable loss. The appropriate remedy depends on the circumstances.
The change-of-mind rules below do not limit those rights.
If you cancel before work starts
I will refund payments for work that has not started, less any reasonable third-party costs that you expressly approved, that have already been incurred specifically for your project, and that cannot reasonably be recovered or transferred to you. I will provide an itemised explanation. There is no automatic deposit-forfeiture or administration fee.
If you cancel after work starts
Please tell me promptly so I can stop further work and avoid unnecessary costs. If you are cancelling for convenience rather than because of a failure covered by law, I will calculate:
- The reasonable value of agreed work actually completed up to cancellation, using agreed milestone amounts or rates where provided, or otherwise a reasonable proportion of the accepted project price supported by a work breakdown.
- Reasonable, expressly approved third-party costs that have been incurred and cannot reasonably be recovered, to the extent they are not already included in the work amount.
- Payments you have already made.
I will provide the calculation and refund any excess payment. If properly chargeable work exceeds your payments, I may invoice the difference. Total charges will not exceed the accepted project price plus separately approved additions. I will not charge for work avoided after cancellation, add a penalty, or charge twice for the same cost.
You will receive the completed work you have paid for, with the ownership and licence arrangements in the Terms of Service. I will explain if unfinished work needs more work before it can be used as a functioning website.
For example, if you have paid $495 towards a Starter website and the reasonable value of completed work is $250 with no additional costs, the refund would be $245. This is an illustration, not a fixed cancellation charge.
If you change your mind after completion
There is no change-of-mind refund for work properly completed in line with your agreement. This includes deciding not to use the website, closing your business or preferring a different design after approving the agreed design. Your statutory rights remain unchanged, including if the work is defective or materially differs from the agreement.
If I cannot complete the project
I will tell you promptly and discuss the options. If I cancel without a breach by you, I will refund amounts for services not delivered. I will only retain an amount for a usable completed part if you agree to accept it and the amount is reasonable. If the undelivered work makes the completed part unusable for the agreed purpose, I will not treat that unusable part as delivered value. This does not limit any additional remedy required by law.
Cancelling a care plan
Care plans are month to month. You can cancel on 14 calendar days' written notice, without an exit fee. I will confirm the end date and any hosting or handover arrangements.
Care fees already paid are not refunded, because the notice period includes collecting your website files and information and handing everything over to you. If the notice period runs into a new billing month, you are charged only for the days of that month up to the end date. For example, if your end date is the 10th day of a new billing month, you pay for those 10 days only.
Unused included change time is not refundable because the plan also provides ongoing hosting management, monitoring and availability for support. None of this affects a refund or other remedy you are entitled to by law if the care service was not provided properly.
I will provide your website files, relevant access and reasonable assistance with a standard handover. Your domain and paid website do not become mine when you cancel.
Third-party purchases
For subscriptions or purchases you contract for directly, the provider handles its own cancellation process. I can help identify the relevant provider. If I supplied a service to you, I will not reject a valid claim merely because another provider was involved. Any recovery from a provider will be taken into account so costs are not charged twice.
Requesting a refund
Please provide your name, project or invoice reference, the issue and the outcome you are seeking. I may ask for reasonable information needed to understand the claim. I will explain my assessment and any proposed remedy.
I aim to acknowledge requests within two business days and provide a substantive response within ten business days. Once a refund amount is agreed or otherwise established as payable, I will process it within ten business days, or sooner if required by law. I will normally use the original payment method unless we agree otherwise. Payment-provider processing time may be additional.
These administrative targets are not a time limit for making a claim and do not postpone a remedy required sooner by law. There is no deduction for processing a refund that you are legally entitled to receive.
